Terms of service
This is a working draft maintained by Curanta and isn't legal advice — please review with counsel before you rely on it. Affiliate program terms live on a separate page.
1. The deal
By creating a Curanta account you agree to these terms. If you're using Curanta on behalf of a business, you're agreeing on that business's behalf.
2. Your account
- You're responsible for anything done from your account.
- Use a real email you control and keep your password secret.
- One human per account. Team members get their own seats.
3. Your content
You own what you upload. You grant Curanta a limited license to host, transcode, and deliver your content so that the service can, well, work. That license ends when you delete the content.
Don't upload content you don't have the right to share, or content that violates law or someone else's rights.
4. Acceptable use
- No illegal content, no CSAM, no non-consensual intimate imagery, no incitement to violence, no phishing.
- No scraping, reselling access, or reverse-engineering the service.
- Don't try to break into other workspaces.
We can suspend or terminate accounts that break these rules. Emergency removals happen without notice; everything else we try to give you a heads-up on.
5. Payment
- Paid plans are billed by Paddle, our merchant of record. Prices, taxes, and refunds are handled per your Paddle receipt.
- Sales you make through the Gallery Shop are processed by your connected processor (Stripe, PayPal, or Square). Curanta takes a platform fee disclosed on the pricing page.
- Fees change from time to time. We'll notify you before a change affects your plan.
Chargebacks and disputes on your sales
Gallery Shop sales settle through Curanta as the merchant of record for the card networks. If a buyer disputes a purchase, the card network takes the disputed amount and its dispute fee from Curanta first — but you, the creator who made the sale, are responsible for it.
- We'll tell you as soon as a dispute opens, with the deadline for evidence, and we'll file whatever you send us.
- The buyer's downloads for the disputed order are switched off while the dispute is open.
- If the dispute is lost, the disputed amount plus the dispute fee (currently $15 per dispute) is deducted from your future payouts, or invoiced to you if your payouts don't cover it.
- If the dispute is won, nothing is deducted and we can restore the buyer's download access on request.
- Repeated disputes may mean we pause selling on your account until the pattern is resolved.
6. Cancellation & termination
You can cancel anytime — details on the cancellation policy. We can terminate accounts that violate these terms; when that happens you get a reasonable window to export your content unless the violation is severe.
7. Warranty & liability
Curanta is provided "as is". We don't guarantee the service will be uninterrupted or error-free. To the extent allowed by law, our liability is capped at what you paid us in the twelve months before the claim.
8. Governing law
These terms are governed by the laws of the State of Georgia, USA. Disputes are resolved in the state or federal courts sitting in Fulton County, Georgia.
